Welcome to Ethnicitees, LLC. These Terms and Conditions govern your use of www.ethniciteesllc.org and purchases from Ethnicitees, LLC. By accessing this website or placing an order, you agree to these Terms and our posted Company Policies.

ABOUT ETHNICITEES

Ethnicitees, LLC creates original educational Black heritage apparel and “Cultural Wearables,” featuring artist-created linocut portraits, illustrations, biographies, and related merchandise. Ethnicitees currently operates online, through mobile vending and events, and does not maintain a permanent storefront.

PRODUCT INFORMATION AND AVAILABILITY

We make reasonable efforts to describe and display products accurately. Actual colors may vary because of screens, lighting, fabrics, ink, printing methods, dye lots, and the handmade character of artwork. Product images are illustrative and may not show every variation.

Sizes, colors, formats, materials, designs, and inventory are subject to availability. We may correct errors, update product information, limit quantities, substitute an agreed item, or cancel an unavailable order. If applicable law requires notice, consent, cancellation rights, or a refund, Ethnicitees will provide them.

ORDERS, PRICES, AND PAYMENT

An order is an offer to purchase and is not accepted until payment is authorized and Ethnicitees confirms or begins fulfilling it. We may refuse or cancel orders involving suspected fraud, payment problems, pricing or listing errors, unavailable inventory, unauthorized resale, or misuse of our artwork.

Customers are responsible for reviewing all product choices, sizes, colors, formats, quantities, personalization details, delivery information, and billing information before submitting an order. Customers are responsible for applicable taxes, shipping charges, and other disclosed fees. Prepaid orders may be eligible for arranged pickup or local delivery.

ALL SALES FINAL — NO RETURNS, REFUNDS, OR EXCHANGES

Except where applicable law requires otherwise, all sales are final. Ethnicitees does not accept returns or exchanges and does not issue refunds for change of mind, buyer’s remorse, incorrect size or color selection, duplicate orders, or other customer ordering errors.

Claims involving a materially damaged, defective, or incorrect item must be reported within three calendar days after confirmed delivery. The customer must provide the order number, a description of the problem, clear photographs of the item, packaging, shipping label, and reported damage or error, plus any reasonably requested information. The item must not be worn, washed, altered, reproduced, resold, or otherwise used. An eligible remedy may include correction, replacement, store credit, or a refund when required by law.

SHIPPING, PICKUP, DELIVERY, AND DELAYS

Processing, production, shipping, pickup, and delivery estimates are not guaranteed dates. Standard USPS service is generally used unless the customer purchases an available express option.

Delays or shortages may result from inventory limitations, supplier or manufacturer shortages, tariffs or trade restrictions, carrier disruptions, pandemics or public-health emergencies, terrorism, national emergencies, acts of war, acts of God, severe weather, power or technology failures, family illness, medical emergencies, or other circumstances beyond Ethnicitees’ reasonable control. When required by applicable law, we will provide notice and any legally required cancellation opportunity, replacement option, or refund.

ARTWORK, COPYRIGHT, AND INTELLECTUAL PROPERTY

All Ethnicitees artwork, linocuts, illustrations, portraits, designs, biographies, text, photographs, product images, logos, graphics, website content, and related creative material are owned by or licensed to Ethnicitees, LLC and are protected by applicable intellectual-property laws.

Purchasing a product transfers ownership of the physical item only. It does not transfer copyright, reproduction, commercial, digital, licensing, or ownership rights in any creative material. Without prior written authorization from Ethnicitees, customers may not copy, scan, trace, reproduce, digitize, vectorize, extract, alter, distribute, manufacture from, commercially display, create derivative works from, use for artificial-intelligence training, or otherwise exploit Ethnicitees artwork or content.

Ordering or receiving a product for the purpose of capturing, copying, reproducing, or duplicating its artwork does not create a right to return the product, request an exchange, obtain a refund, or retain unauthorized reproductions.

WEBSITE USE

You may use this website only for lawful personal shopping and informational purposes. You may not interfere with website operation, attempt unauthorized access, introduce malicious code, scrape or harvest content, impersonate another person, submit false information, infringe intellectual-property rights, or use the website or its content for fraudulent or unlawful activity.

THIRD-PARTY SERVICES AND LINKS

The website may use or link to third-party payment processors, shipping carriers, social networks, or other services. Their separate terms and privacy practices may apply. Ethnicitees is not responsible for third-party websites or services outside its reasonable control.

DISCLAIMER AND LIMITATION OF LIABILITY

To the fullest extent permitted by law, the website and its content are provided “as is” and “as available.” Ethnicitees does not guarantee that the website will always be uninterrupted, error-free, or free of harmful components.

To the fullest extent permitted by law, Ethnicitees, LLC will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from website use, delayed or unavailable products, or a purchase. Nothing in these Terms excludes or limits a right, warranty, remedy, or liability that cannot legally be excluded or limited.

CHARGEBACKS AND FALSE CLAIMS

Customers should contact Ethnicitees before initiating a payment dispute so a legitimate concern can be reviewed. Ethnicitees reserves the right to contest inaccurate, fraudulent, or abusive chargebacks using order records, delivery confirmation, correspondence, photographs, and other relevant documentation.

GOVERNING LAW AND SEVERABILITY

These Terms are governed by the laws applicable in the State of Maryland, without limiting any mandatory consumer protection that applies to the customer. If a provision is found invalid or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect.

CHANGES TO THESE TERMS

Ethnicitees may update these Terms from time to time. The version posted when an order is placed will govern that transaction unless applicable law requires otherwise.
